NHS Fife nurse Sandie Peggie has been suspended and disciplinary investigated after she objected to sharing a women's changing room with transgender doctor Beth Upton, who was born male but identifies as female. Peggie claimed she had been discriminated against and victimized because of her belief that biological sex was immutable, and brought a claim against NHS Fife and Upton for sexual harassment, discrimination and victimization under the Equality Act 2010. After an 18-month internal investigation, Peggie was cleared of gross misconduct and allowed to return to work, albeit with certain restrictions and changes to her working hours. An employment tribunal found that Peggie was harassed by NHS Fife, but that there was no discrimination or harassment. The case centered on the legal question of whether a transgender person is allowed to use the locker room according to their gender identity. The tribunal also dealt with the dispute about the use of pronouns when referring to Dr. Upton, with the judge deciding to use the neutral or feminine pronoun "out of respect." NHS Fife is reviewing its policies in line with new guidance from the Equality and Human Rights Commission. The entire process began in December 2023 and the trial was held in 2025[1][2][3].
