An employment tribunal in Newcastle has found that County Durham and Darlington NHS Foundation Trust breached the dignity of seven nurses by allowing transgender Rose Hender to use the women's changing room. This policy of the trust created a "hostile, humiliating and degrading environment" for women. The court confirmed the claims of indirect discrimination on the basis of gender and partly of harassment. The tribunal rejected further claims of harassment and victimization by the trans person. The decision differs from two other cases against NHS employers which reached different conclusions. The UK government is under pressure to issue guidelines to implement a 2025 High Court ruling on trans people's access to single-sex spaces. A trans person has the right to protection against discrimination, but this does not translate into a positive right.[1][2][3]
