The American Academy of Pediatrics (AAP) filed a lawsuit against Robert F. Kennedy's Department of Health and Human Services (HHS) for illegal changes in vaccination policy.[3] The lawsuit seeks to remove the COVID-19 vaccine from the CDC's recommended immunization schedule for children and pregnant women, which the plaintiffs say violates the Administrative Procedure Act.[1] The scope of the lawsuit also extended to changes in the composition of the ACIP committee, which advises the CDC on vaccines, and the shortened vaccination schedule from January.[3] After a day of oral arguments in a packed courtroom in Boston, federal judge Brian E. Murphy did not rule immediately and asked for more information, including the DOJ's response to the plaintiffs' statements, by the end of Wednesday.[3] The judge previously affirmed that the AAP and other health groups have standing in court and denied HHS's motion to dismiss the lawsuit.[2][8] The AAP is pursuing a separate lawsuit against HHS for withdrawing $12 million in grants it says is in retaliation for criticism of vaccination policy.[4][7] Plaintiffs seek an injunction to reinstate the recommendations and reconstitute ACIP with new members in good faith.[2]
