The UK High Court has ruled that injured children can claim compensation for lost earnings for a full healthy working life. This decision concerns children who have suffered brain damage at birth due to clinical negligence. Previously, an appeals court in 1981 limited the claim to the period of life expectancy, which for many is shortened due to injury. Judges have now lifted this restriction and allowed a claim for the full period during which the uninjured child would have worked and received a pension. An example is a child with pain, convulsions, profound learning difficulties, severe visual impairment, respiratory impairment and epilepsy, with an expected life expectancy of 29 years.
