Cardiology Group to Pay Nearly $5 Million for Alleged Vein Ablation Fraud

Phoenix, Arizona-based Tri-City Cardiology Group and three doctors have agreed to pay $4.75 million to settle allegations of violating the False Claims Act.[1][3] The charges relate to performing medically unnecessary perforator vein ablations between January 1, 2017 and April 27, 2022.[3][5] Doctors Dr. Jaskamal Kahlon, Dr. Joshua D. Cohen and Dr. M. Joshua Berkowitz allegedly performed procedures on veins that did not meet accepted medical standards.[3] According to the charges, they falsified records of bleeding duration, vein diameter, patient symptoms, and conservative therapies to make the procedures appear legitimate.[1][5] They billed these procedures to Medicare, Medicaid, TRICARE, and the Office of Veterans Affairs.[1] The agreement does not indicate the determination of guilt, it is only a resolution of the charges.[3] The group and doctors must establish a corporate integrity agreement with the Department of Health and Human Services to secure future regulations.[1]
