New legislation introduced in the US House of Representatives will exempt doctors and other healthcare professionals from the $100,000 H-1B visa application fee. The fee was introduced by Presidential Executive Order dated September 19, 2025, which requires employers to pay for new H-1B petitions filed beginning September 21, 2025. It applies to non-U.S. workers without a valid H-1B visa stamp, applications for consular processing, or cases where USCIS denies a change of status. Exceptions apply to those with a valid H-1B visa before September 21, petitions filed before that date, changes in US status, or extensions of stay. Legislators Mike Lawler (R-N.Y.) and Sanford D. Bishop, Jr. (D...) proposed bipartisan legislation. USCIS issued guidance on October 20, 2025 detailing online portal payment and exceptions in extremely rare cases.
